We take your privacy very seriously and are committed to protecting your personal information and your right to privacy. In this privacy notice, we describe our privacy policy and seek to explain to you in the clearest way possible the information we collect, how we use it and what rights you have in relation to it under applicable privacy and data protection laws. These laws may include, depending on your location, U.S. state privacy laws (such as the California Consumer Privacy Act as amended by the California Privacy Rights Act (“CPRA”), and similar laws in other U.S. states), as well as the European Union General Data Protection Regulation (“GDPR”) and the UK GDPR.

This privacy policy applies to all information that may be collected from time-to-time through our Site and/or any related services, sales, marketing or events (we refer to all of these collectively in this privacy policy as the “Sites”).

 

1. WHAT INFORMATION DO WE COLLECT?
We collect personal information that you voluntarily provide to us when you engage with or register on the Sites, express an interest in obtaining information about us or our products and services, submit an inquiry or request throught he Site, or otherwise contact us. The personal information that we collect depends on the context of your interactions with us and the Sites, the choices you make and certain features you use. All personal information that you provide to us must be true, complete and accurate, and you must notify us of any changes to your personal information. The personal information we collect may include the following:

  • Name and Contact Data. If you complete a contact form on the Sites, we collect your first and last name, company name, general location, email address, postal address, phone number, and other similar contact data. Submission of such information is optional, and certain fields may be left blank at your discretion.
  • Credentials. If we require password creation for access to the Sites or otherwise, at times we may collect passwords, password hints, and similar security information used for authentication and account access. We do not currently offer user accounts or login functionality on the Sites. If access-controlled features are added in the future, this information may be collected at that time.
  • Payment Data. At the present time we do not collect payment data via the Site, but in the event we decide there is a need in the future to process a payment for certain purchases you make with us, we would collect data necessary for processing a payment such as your payment instrument number (i.e., such as a credit card number) and the security code associated with your payment instrument. All payment data in such cases would be stored by our payment processor and you would be directed to review its privacy policies and to contact the payment processor directly to respond to your questions. Any such payment data would be collected and used solely for transaction-processing purposes.

Information automatically collected
We automatically collect certain information when you visit, use or navigate the Sites. This information does not reveal your specific identity (e.g., your name or contact information) but may include device and usage information, such as your IP address, browser and device characteristics, operating system, language preferences, referring URLs, device name, country, general location information, information about how and when you use our Site and other technical information. This information is primarily needed to maintain the security and operation of our Sites, and for our internal analytics and reporting purposes. Like many businesses, we also collect information through cookies and similar technologies, including through tools such as Google Analytics and Google Tag Manager.

Information potentially collected from other sources
In order to enhance our ability to provide relevant marketing, offers and services to you and update our records, we may obtain information about you from other sources, such as public databases, aviation industry sources, joint marketing partners, as well as from other third parties. Examples of the information we could potentially receive from other sources may include any information that you choose to make public, marketing leads and search results and links.

Sensitive Personal Information
We do not collect sensitive personal information through the Sites. In limited circumstances unrelated to general website use, such as during aircraft transactions, facility access, or compliance and know-your-customer (KYC) processes, we may temporarily receive copies of identification documents (for example, passports or driver’s licenses) from crew members, visitors, buyers, sellers, or other transaction participants. Such information is typically provided directly by email or other secure means, is used solely for the specific transaction or compliance purpose, and is deleted once the transaction, access requirement, or related services are completed.

 

2. HOW DO WE USE YOUR INFORMATION?
We may use personal information collected via our Sites for a variety of business purposes. Par Avion does not sell, rent or lease its customer lists to third parties. Par Avion may, from time to time, contact you on behalf of external business partners about a particular offering that may be of interest to you. We process your personal information for these purposes in reliance on our legitimate business interests (“Business Purposes”), in order to enter into or perform a contract with you (“Contractual”), with your consent (“Consent”), and/or for compliance with our legal obligations (“Legal Reasons”). Certain uses of personal information described below may be considered “targeted advertising” under some U.S. state privacy laws, and where required we provide appropriate opt-out rights.
We indicate the specific processing grounds we rely on next to each purpose listed below. We use the information we collect or receive:

  • To send you marketing and promotional communications for Business Purposes and/or with your Consent. We and/or our third party marketing partners may use the personal information you send to us for our marketing purposes. Marketing communications may include newsletters, aircraft listings, informational content, videos, and other updates distributed through email platforms such as MailerLite or similar services. You can opt-out of any marketing emails that we may send at any time. Where required by law, we will obtain your opt-in consent before sending marketing communications, and you may withdraw your consent at any time.
  • To send administrative information to you for Business Purposes, Legal Reasons and/or possibly Contractual. We may use your personal information to send you product, service and/or information about changes to our terms, conditions, and policies.
  • To post testimonials with your Consent. Although we currently do not post testimonials, we may from time to time decide to post testimonials on our Sites that may contain personal information. Prior to posting a testimonial, we will obtain your Consent to use your name and testimonial. If you wish to update, or delete your testimonial, please contact us at the above provided email contact address and be sure to include your name, testimonial location, and contact information.
  • Deliver targeted advertising to you for our Business Purposes and/or with your Consent. We may use your information to develop and display content and advertising (and work with third parties who do so) tailored to your interests and/or location and to measure its effectiveness. At present, we do not embed third-party advertising pixels on the Site. Any targeted outreach is typically conducted using industry databases or offline tools rather than through cross-context behavioral advertising on the Site. If this changes, you will be provided with any required opt-out rights under applicable U.S. state privacy laws.
  • Request Feedback for our Business Purposes and/or with your Consent. We may use your information to request feedback and to contact you about your use of our Sites.
  • To protect our Sites for Business Purposes and/or Legal Reasons. We may use your information as part of our efforts to keep our Sites safe and secure (for example, for fraud monitoring and prevention).
  • To enforce our terms, conditions and policies for Business Purposes, Legal Reasons and/or possibly Contractual.
  • To respond to legal requests and prevent harm for Legal Reasons. If we receive a subpoena or other legal request, we may need to inspect the data we hold to determine how to respond.
  • For other Business Purposes. We may use your information for other Business Purposes, such as data analysis, identifying usage trends, determining the effectiveness of our promotional campaigns, supporting aircraft-related inquiries and transactions, and to evaluate and improve our Sites, products, services, marketing and your experience.
  • Automated Decision-Making. We do not use personal information for automated decision-making or profiling that produces legal or similarly significant effects as defined under the GDPR or UK GDPR.

 

3. WILL YOUR INFORMATION BE SHARED WITH ANYONE?
We only share and disclose your information in the following situations:

  • Compliance with Laws. We may disclose your information where we are legally required to do so in order to comply with applicable law, governmental requests, a judicial proceeding, court order, or legal process, such as in response to a court order or a subpoena (including in response to public authorities to meet national security or law enforcement requirements).
  • Vital Interests and Legal Rights. We may disclose your information where we believe it is necessary to investigate, prevent, or take action regarding potential violations of our policies, suspected fraud, situations involving potential threats to the safety of any person and illegal activities, or as evidence in litigation in which we are involved.
  • Vendors, Consultants and Other Third-Party Service Providers. We may share your data with third party vendors, service providers, contractors or agents who may from time-to-time perform services for us or on our behalf and require access to such information to do that work. Examples include: data analytics, website hosting services, email communications, marketing support, and information technology services. These vendors may include service providers such as website analytics providers (e.g., Google Analytics), email marketing platforms (e.g., MailerLite), and digital marketing consultants. We require such third parties to protect personal information and to use it only for the purposes for which it is disclosed. This may include third-party service providers engaged to perform compliance, verification, or know-your-customer (KYC) checks, as well as sharing limited personal information with other transaction participants where necessary to facilitate or complete a requested transaction.
  • Business Transfers. We may share or transfer your information in connection with, or during negotiations of, any merger, sale of company assets, financing, or acquisition of all or a portion of our business to another company.
  • Third-Party Advertisers. We may use third-party advertising companies to serve ads when you visit the Sites. These companies may use information about your visits to our Website(s) and other websites that are contained in web cookies and other tracking technologies in order to provide advertisements about goods and services of interest to you. At present, we do not permit third-party advertising companies to place advertising pixels directly on the Site for cross-context behavioral advertising purposes.
  • Affiliates. We may share your information with our affiliates, in which case we will require those affiliates to honor this privacy policy. Affiliates include our parent company and any subsidiaries, joint venture partners or other companies that we control or that are under common control with us.
  • Business Partners. We may share your information with our business partners to offer you certain products, services or promotions. We have informed our Business Partners and they are aware of our Privacy Policy. In the event such Business Partners do not have a privacy policy equal to or greater in its restrictive nature as this Privacy Policy, we have asked them to comply with this policy as it relates to any information that we share with them about you. In practice, such sharing is generally limited to aviation-related partners or brokers involved in responding to your inquiry or facilitating a requested service.
  • With your Consent. We may disclose your personal information for any other purpose with your consent.
  • No Sale of Personal Information. We do not sell personal information, and we do not knowingly share personal information for cross-context behavioral advertising as defined under the California Consumer Privacy Act, as amended by the California Privacy Rights Act (“CPRA”). If our practices change, we will update this policy and provide any required opt-out rights.

 

4. DO WE USE COOKIES AND OTHER TRACKING TECHNOLOGIES?
We may use cookies and similar tracking technologies (such as analytics tools) to access or store information. We may also use cookies to remember you when you return to the Sites as well as to identify the pages you click on during your visit to our Sites and, in some cases, the name of the website you visited immediately before clicking to the Par Avion Ltd. Sites. We use this information to improve our site design, customer service, and to better understand how visitors interact with the Sites through aggregated analytics data. The Sites currently use Google Analytics and Google Tag Manager to collect and analyze this information. These tools help us understand website traffic patterns and usage trends. We do not embed third-party advertising pixels on the Sites for cross-context behavioral advertising purposes. You can, of course, disable cookies on your computer by indicating this in the preferences or options menus in your browser. However, it is possible that some parts of our Website will not operate correctly if you disable cookies. Please note that our Sites’ servers are located in the United States. In short, we are not responsible for the safety of any information that you share with third-party providers who may advertise, but are not affiliated with, our websites. The Sites may contain advertisements from third parties that are not affiliated with us and which may link to other websites, online services or mobile applications. We cannot guarantee the safety and privacy of data you provide to any third parties. Any data collected by third parties is not covered by this privacy policy. We are not responsible for the content or privacy and security practices and policies of any third parties, including other websites, services or applications that may be linked to or from the Sites. You should review the policies of such third parties and contact them directly to respond to your questions. Where third-party websites or services are accessed through links on the Sites, your interactions with those third parties are governed by their own privacy policies and practices, not this privacy policy. To the extent that third-party advertising, analytics, or similar technologies are used on the Sites, such third parties may collect information independently in accordance with their own privacy policies. We do not control and are not responsible for such third-party data collection activities. Under applicable U.S. state privacy laws, including the California Consumer Privacy Act as amended by the California Privacy Rights Act (“CPRA”), you may have the right to opt out of certain data practices if they constitute “sharing” for cross-context behavioral advertising. As described elsewhere in this policy, we do not currently engage in cross-context behavioral advertising through the Sites.

 

7. HOW LONG DO WE KEEP YOUR INFORMATION?
We will only keep your personal information for as long as it is necessary for the purposes set out in this privacy policy, unless a longer retention period is required or permitted by law. The length of time for which we retain personal information depends on the nature of the information, the purpose for which it was collected, and applicable legal or business requirements. More specifically, we generally retain personal information submitted through inquiries or communications for as long as reasonably necessary to respond to your inquiry, maintain our business relationship, and address related business or legal needs. We may keep certain of your information for a longer period for purposes of future business consultation, aircraft discussions, or related reasons, unless and until you request deletion or applicable law requires earlier deletion. When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize it, or, if deletion is not feasible (for example, because the information is stored in backup archives), securely store the personal information and isolate it from any further processing until deletion is possible. To be clear, this retention approach does not relate to general emails or routine communications from you, but rather relates to personal information obtained during our business relationship or in connection with specific inquiries or transactions.

 

8. HOW DO WE KEEP YOUR INFORMATION SAFE?
We have implemented security measures such as fire walls and other means of blocking access to certain of your personal information. We use commercially reasonable administrative, technical, and physical safeguards designed to protect the personal information we access and process. Please know that these measures are all designed to protect the security of personal information we access and process. However, please also remember that we cannot guarantee that the internet itself is 100% secure. No method of transmission over the internet or method of electronic storage is completely secure. Although we will do our best to protect your personal information, your transmission of personal information to and from our Sites is at your own risk. You should only access the Sites and services within a secure environment..

We do not knowingly solicit data from or market to children under 18 years of age. California Civil Code Section 1798.83, also known as the “Shine The Light” law, permits our users who are California residents to request and obtain from us, once a year and free of charge, information about categories of personal information (if any) we disclosed to third parties for direct marketing purposes and the names and addresses of all third parties with which we shared personal information in the immediately preceding calendar year.
